Law there is no difference between ‘Peon’ and PM

Islamabad (March 16, 2012): Naib Amir of Jamaat-e-Islami Pakistan and ex-Member of
the Senate of Pakistan, Prof. Khurshid Ahmad has expressed his grief and shock
on the statement of the Prime Minister Syed Yousaf Raza Gilani openly insulting
the Supreme Court and claiming that if he writes a letter to the Swiss
authorities in compliance with the orders of the Supreme Court he would violate
the Constitution and may expose himself to punishment under Article 6. Mr.
Gilani has also claimed that Superior Courts are treating him as ‘peon’ and not
the PM.
Prof.
Khurshid Ahmad reminded Mr. Gilani that in the eyes of law there is no
difference between ‘Peon’ and ‘PM’. Equality before law is a fundamental
principle of Islam, contemporary jurisprudence and the Constitution of Islamic
Republic of Pakistan. He also reminded the Prime Minister that there is an
Article 4 in the Constitution which categorically states equality before law as
inalienable right of every citizen irrespective of position. According to Prof. Khurshid the Prime
Minister has demonstrated feudal mindset in its worst form. The ex-Senator has
also reminded the PM that there is an Article 190 in the Constitution which
makes it obligatory on all executive and judicial authorities throughout
Pakistan shall act in aid of the Supreme Court. The Article 248 does not
provide blanket immunity to the President and as far as civil issues are
concerned they do not fall under Article 248.
“The
Prime Minister has waged a war against the Supreme Court and the Constitution
and as such he has already committed a
crime of subverting the Constitution as clearly stated in Article 6 which is
haunting Mr. Gilani”, Prof. Khurshid stressed.
While
concluding the statement Prof. Khurshid Ahmad condemned this outrageous game of
politicking and expressed the hope that Supreme Court and the Parliament will
respond to establish the supremacy of law and equality of all before law.
